Unlike the Russian reproductive medicine legislation the Ukrainian one is much more liberal. Besides an agreement on signing in of both spouses as a child parents a surrogate mother in Russia has also to sign an application stating that she will not claim her parental rights for a child after its birth, refusing from it in such way. 

Such refusal is not needed in Ukraine, it is enough to have surrogate mother’s notarized agreement on registration of conjoints as a child parents. 

The Russian Family Code requires the additional preparations also from biological parents (i.4 article 51) in the form of agreement for a surrogate mother embryo implantation. Furthermore, Russian surrogate mother has a right to avoid a biological mother maternity in a court (i.1 article 51)

Ukraine has a totally different approach to this question. The article 139 i.2 of the Ukrainian Family Code affirms that the surrogate maternity program does not allow any maternity litigate.
